1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of Office Pulse and any related services provided by Trizoun ("we", "us", or "our").

By downloading, installing, accessing, or using Office Pulse, you agree to be bound by these Terms. If you do not agree, do not use the app.

If you download Office Pulse from Apple's App Store, your use is also subject to Apple's applicable terms, rules, and policies.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Office Pulse for your personal, non-commercial use on compatible devices that you own or control, except as otherwise permitted under Apple's usage rules.

No ownership rights in the app are transferred to you. We and our licensors retain all rights, title, and interest in and to the app and related intellectual property.

3. Eligibility

You may use Office Pulse only if:

  • You have the legal capacity to enter into a binding agreement
  • Your use complies with applicable law
  • Your use complies with App Store and device-platform rules that apply to you

If you are using the app on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

4. App Functionality

Office Pulse is a puzzle game. Features may include:

  • Gameplay levels and progress systems
  • Local save data
  • Audio and haptic features
  • Sharing features
  • Ad-supported functionality
  • Paid ad-free functionality
  • Other features introduced in later releases

We may add, modify, suspend, or remove features at any time, subject to applicable law.

5. Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose
  • Interfere with or disrupt the app's normal operation
  • Attempt to gain unauthorized access to systems, data, or code
  • Reverse engineer, decompile, disassemble, or attempt to extract source code except to the extent such restriction is prohibited by law
  • Circumvent technical protections, licensing mechanisms, purchase validation, or ad controls
  • Use bots, scripts, automation, or exploits to manipulate gameplay, purchases, rankings, or app behavior
  • Upload, transmit, or distribute malware or harmful code through any app-connected feature
  • Misrepresent your identity in support or purchase-related communications

6. Accounts

Office Pulse currently may not require a dedicated in-app account for core gameplay. However, certain platform-level functionality may depend on Apple services, device settings, or platform accounts.

You are responsible for:

  • Maintaining the security of your device
  • Maintaining the security of your Apple account
  • Any activity that occurs through your device or account, to the extent permitted by law

7. Local Data and Progress

The app may store gameplay progress, settings, statistics, and monetization state locally on your device.

You acknowledge that:

  • Local data may be lost due to deletion, reinstall, restore actions, device changes, system resets, corruption, or other events
  • We do not guarantee permanent availability of local data unless a specific cloud or account-based feature is explicitly offered in a released version

8. Advertising

Office Pulse may include advertisements in certain versions or modes of the app.

By using an ad-supported version of the app, you acknowledge that:

  • Ads may appear at intervals determined by the app design
  • Ads may be served or managed by third-party advertising providers
  • Ad availability and format may vary by platform, region, release, or device

We do not guarantee that advertisements will always be available, error-free, or personalized.

9. In-App Purchases and Ad-Free Unlock

Office Pulse may offer digital purchases, including a one-time purchase to remove ads or unlock additional functionality.

On iOS:

  • Digital purchases must be offered through Apple's in-app purchase system where required by Apple's rules
  • Payment processing is handled by Apple
  • Pricing, taxes, billing, and refunds may be subject to Apple's terms and policies

Unless otherwise stated in the released app listing or applicable law:

  • The ad-free purchase is intended as a non-consumable entitlement for the applicable app account or Apple ecosystem behavior supported by Apple
  • Entitlements may require restore or verification actions
  • We may require a valid transaction state before enabling a purchase-based feature

If a purchase appears not to apply correctly, contact support.

10. Refunds

Refunds for App Store purchases are generally handled by Apple, not by us directly.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

11. Intellectual Property

All content, features, software, code, game mechanics, visual elements, audio, text, branding, and other materials associated with Office Pulse are owned by us, licensed to us, or otherwise protected by applicable intellectual property laws.

You may not:

  • Copy, reproduce, distribute, publicly perform, or create derivative works from the app except as expressly allowed
  • Remove proprietary notices
  • Use our name, logo, or branding in a way that suggests endorsement without permission

Third-party assets, SDKs, and platform materials remain subject to their own licenses and rights.

12. User Feedback

If you provide suggestions, comments, ideas, or other feedback regarding Office Pulse, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, translate, distribute, and otherwise exploit that feedback without compensation to you, unless prohibited by law.

13. Availability and Updates

We may release patches, bug fixes, updates, or new versions at any time. Certain features may stop working properly if you do not install updates.

We may also suspend or discontinue all or part of the app, subject to applicable law.

We are not liable for delays, interruptions, or failures caused by:

  • Apple platform issues
  • Device compatibility problems
  • Third-party providers
  • Internet or system failures
  • Events beyond our reasonable control

14. Third-Party Services and Links

The app may interact with third-party services or direct you to third-party destinations, including:

  • Apple services
  • System share destinations selected by you
  • Advertising or monetization partners
  • Support or hosted web pages

We are not responsible for third-party acts, omissions, content, policies, or systems.

15. Privacy

Your use of the app is also governed by the Office Pulse Privacy Policy. Please review it carefully.

16. Disclaimer of Warranties

To the maximum extent permitted by law, Office Pulse is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • The app will be uninterrupted
  • The app will be error-free
  • The app will be secure in all circumstances
  • Bugs will always be corrected
  • The app will be compatible with every device, operating system, or region

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, licensors, service providers, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, goodwill, data, or business opportunities, arising out of or related to your use of or inability to use Office Pulse.

To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to Office Pulse shall not exceed:

  • The amount you paid for the app or relevant in-app purchase in the 12 months before the event giving rise to the claim, or
  • If you paid nothing, a nominal amount of USD 10, whichever is greater, unless applicable law requires otherwise

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

18. Termination

These Terms remain in effect until terminated.

We may suspend or terminate your access to the app or certain features if:

  • You violate these Terms
  • We are required to do so by law
  • Continued operation is no longer commercially or technically feasible

Upon termination:

  • Your rights under these Terms end
  • You must stop using the app if required by law or our notice
  • Provisions that by their nature should survive termination will survive

19. Export and Sanctions Compliance

You agree to comply with applicable export control and sanctions laws. You represent that you are not located in, under the control of, or a national or resident of any prohibited jurisdiction, and are not on any list of restricted parties where use would be prohibited by law.

20. Governing Law and Dispute Resolution

  • In the event of a failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, in accordance with its policies; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app
  • Apple is not responsible for addressing claims relating to the app or your possession and use of the app, including product liability claims, legal compliance claims, and consumer protection claims, except as required by law
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after your acceptance

22. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the "Last updated" date above. Continued use of the app after updated Terms become effective constitutes acceptance of the updated Terms, except where additional notice is required by law.
